Entrapment is defined and distinguished from related law enforcement practices. The subjective test of entrapment formulated by the Supreme Court and the objective test proposed by critics are discussed and evaluated. The argument is advanced that entrapment is a morally unjustifiable practice which is inconsistent with the rights of citizens in a democratic society. Guidelines are proposed for governing police conduct in potential entrapment situations and suggestions made regarding ways these guidelines might be implemented.

In both aspects, Holmes echoes Dei Verbum (DV, §§2, 13). However, rather than pursuing (...) a revelation-historical organization or beginning with Scripture's texts to derive conclusions about its nature and purpose, the book takes a "top-down" (13) approach to bibliology. In this way, its strength is the theological framing or refraining it gives to common questions.The first three chapters culminate, he claims, in a "definition of Scripture" (11). Beginning with the Trinity and creation, Holmes argues that all things have their being by participating in the inner life (the Word) of the Father, thus reflecting him, and that the Spirit drives creatures "toward the pattern of the Son" (33). God desires creatures to be good and causes of goodness in others, patterned after and in the Son through the Spirit's impulse to return them to God. In the Incarnation, God "reconciles nature with grace" (39) and in Christ perfects these desires. In Christ, man is now "included in the life of the Trinity" (37) and an agent of revelation, reflects God perfectly, and in love sends the Spirit to return humans to God through himself. This leads to reflections on Scripture directly. "Scripture is meant to impress the interior life of the Church on each generation; put another way, it is meant to impress Christ the Head on the members of his Mystical Body" (69). This brings Holmes to the topics of inspiration and canon. In order for human texts to impress Christ on his members, to communicate the divine through human means, "God himself" must be "addressing the [End Page 393] heart of the believer" (72). He makes a case for canon by pointing to the communal nature of humans. Tradition and canon, by which truth as a common good is formulated for a society, order and inform the society regarding its purpose, history, and character. "Tradition," then, "is good for man as man" (57) even in natural society, and all the more so in the supernatural society, the Church. The "texts that embody and transmit the tradition" (63) give continuity and life to the organism that is the Church, while within that tradition these texts can function as a sort of "guide rail" and a "mirror" of its identity (67).This overall view of Scripture lends perspective to particular topics (chs. 4-12). Turning to Scripture's authorship and inspiration, Holmes emphasizes again that God means humans to be real causes of revelation as God "attaches his voice" to their writing (82, 91, and throughout). This may, in differing circumstances, involve endowing them with particular and even unusual graces, many of which God grants to others who hand on revelation (such as Augustine), but in the case of the biblical authors the ("only") difference is that God "intended" biblical texts like Luke "to sound not only Luke's voice but God's voice as well" (91). God writes the notes to be played and selects the instruments, and God "asserts what the human author asserts" (210). But the particularities of an author's soul (and upbringing, assumptions, etc.) can be seen in anything from grammatical infelicities in Paul to the author's assumptions about a geocentric solar system, the goodness of killing the Canaanites, or Qoheleth's unawareness of an afterlife. The chin, a distinguishing feature of Homo sapiens, has sparked ongoing debates regarding its evolutionary origins and adaptive significance. We contend that these controversies stem from a fundamental disagreement about what constitutes a well-defined biological trait, a problem that has received insufficient attention despite its recognized importance in biology. In this paper, we leverage paleoanthropological research on the human chin to investigate the general issue of character or trait identification. First, we examine four accounts of the human chin from the (...) existing literature: the mandibular differential growth byproduct, the bony prominence, the inverted T-relief, and the symphyseal angle. We then generalize from these accounts and propose a three-stage framework for the process of character identification: description, detection, and justification. We use this framework to reinterpret the four accounts, elucidating key points of contention surrounding the chin as well as other morphological characters. We show that debates over the chin carry broad and important biological implications that extend beyond this trait and that are not mere semantic issues of definition. (shrink)

Maclntyre The variety of human cultures fascinated Enlightenment thinkers and evoked certain problems for philosophical discussion. Wide experience of other societies, as well as the study of history, disclosed moral systems interestingly different from modern European mores. Also a student of other cultures, historical and contemporary, David Hume is a moderate pluralist on the matter of alternative moral systems. (...) He acknowledges that there are systems of values other than that shared by his readers which qualify as moralities; but more interestingly, he also holds that there are some such systems which, despite the claims of their adherents, fail to qualify as moralities. Thus Hume opposes forms of relativism that allow any system which a community deems to be a moral code has to be acknowledged as constituting a genuine morality. In this paper I address the question of how Hume can discriminate among value systems and declare some to be moralities, some not. Given the design of his philosophical approach to morals, addressing this question is a matter of some importance for Hume, since he maintains that moral reflection takes its departure from everyday moral beliefs and sentiments. This being the case, we might expect that what should count as 'everyday moral beliefs and sentiments' would be whatsoever any individual or group puts forward as a morality, and that Hume's pluralism impedes him from raising a critical challenge to any system advanced, no matter how strange it might be. But Hume holds that certain systems advanced for the guidance of life which are sharply opposed to 54 everyday beliefs and sentiments do not constitute a morality, even if they number many as adherents. It is instructive to observe that A.C. Maclntyre believes that Hume's position is deeply flawed. He asserts that the treatment of rival tables of the virtues constitutes a most serious weakness in Hume's 2 theory of morals. Maclntyre contends that Hume's spurning of the monkish virtues, for instance, or his preference of Cicero's Offices over the Christian Whole Duty of Man, is devoid of theoretical justification and amounts to a matter of personal idiosyncrasy and eighteenth-century class elitism. Thus this seems a problem worthy of discussion. In what follows I shall: (a) lay out the problem of artificial lives as it arises in A Dialogue; (b) describe five points of differentiation between artificial lives and nonartificial lives; (c) review some less than fully satisfactory solutions to the problem; (d) introduce what I take to be the chief considerations supporting Hume's rejection of artificial lives; and finally (e) discuss whether Maclntyre 's objections to Hume's treatment of artificial lives are sustainable. 1. The Context of the Problem Hume deals with diversity of morals most expressly in A Dialogue, the short work appended to the second Enquiry. The essay records an exchange between one Palamedes, a lover of the novel and the striking, and his interlocutor, referred to merely as "I". Palamedes confounds the interlocutor by narrating a story about a distant people (the inhabitants of 'Fourli") whose mores include practices, apparently deemed moral by them, which sharply offend his, and presumably our, moral A sensibilities. Having elicited the interlocutor's 55 felt disapproval of those practices, Palamedes delights in revealing that the people of whom he has been speaking in cloaked terms are none other than the interlocutor's beloved Greeks of classical antiquity. Not satisfied with astonishing the interlocutor, he goes on to draw a strongly relativist conclusion about morals in general. The interlocutor confronts the choice of either abandoning his moral admiration of the civilization of the Greeks or of accepting some measure of the relativism in morals that Palamedes is advocating. The interlocutor does neither. He distinguishes between the principles of moral approbation or disapprobation and specific examples of approval or disapproval (E 333). He grants that there are examples of practices of which the ancients apparently approved and contrariwise we disapprove, but he denies that the existence of some such instances warrants the serious sort of relativism that Palamedes would foist on him. To better understand the work of pre-Darwinian British life researchers in their own right, this paper discusses two different styles of reasoning. On the one hand there was analysis:synthesis, where an organism was disintegrated into its constituent parts and then reintegrated into a whole; on the other hand there was palaetiology, the historicist depiction of the progressive specialization of an organism. This paper shows how each style allowed for development, but showed it as moving in opposite directions. In analysis:synthesis, development (...) proceeded centripetally, through the fusion of parts. In palaetiology, development moved centrifugally, through the ramifying specialization of an initially simple substance. I first examine a community of analytically oriented British life researchers, exemplified by Richard Owen, and certain technical questions they considered important. These involved the neurosciences, embryology, and reproduction and regeneration. The paper then looks at a new generation of British palaetiologists, exemplified by W.B. Carpenter and T.H. Huxley, who succeeded at portraying analysts' questions as irrelevant. The link between styles of reasoning and physical sites is also explored. Analysts favored museums, which facilitated the examination and display of unchanging marine organisms while providing a power base for analysts. I suggest that palaetiologists were helped by vivaria, which included marine aquaria and Wardian cases. As they became popular in the early 1850s, vivaria provided palaetiologists with a different kind of living and changing evidence. Forms of evidence, how they were preserved and examined, and career options all reinforced each other: social and epistemic factors thus merged. (shrink)

Among the more significant developments of the twentieth century, the widespread attention given to 'rights issues' must surely justify ranking it somewhere near the top. Never before has the issue of rights attracted such a wide audience or stirred so much controversy. Until very recently 'rights' were traditionally recognized as attributable only to humans. Today, we increasingly are hearing a call to extend 'rights' to the nonhuman animal and, on occasion, to the environment. In this book, James B. Reichmann, (...) S.J., undertakes an investigation of the metaethical grounds of 'rights' theory, with special focus on the controversial issue of whether creatures other than humans can and should be considered true subjects of 'rights.' He contends that before assigning rights to this or that individual or group, whether human or not, we need to be very clear about what it is we are assigning, to whom, and why. The book argues forcefully that the various recent efforts to build a case supporting animal and environmental 'rights' fail in their quest, and that any such effort resting on a Darwinian evolutionary base is likewise condemned to fail. In furtherance of this claim the author first investigates life phenomena, followed by a detailed comparative study of knowing, communicating and doing, as these are observed in the human and the nonhuman animal. This in turn is followed by an overview of diverse views advanced by contemporary environmental ethicists and animal 'rights' advocates, including Peter Singer, Tom Regan, J. Baird Callicott, Laura Westra, and Don E. Marietta, Jr. Representative though doubtless provocative conclusions drawn from this study include the claims that: (1) Classic Darwinian theory provides no admissable premise from which to derive a theory of inherent, inalienable rights. (2) No satisfactory explanation of the origin of rights and obligation can derive save from within the context of natural law theory. (3) The human person alone unqualifiedly possesses rights. (4) The view that vegetarianism is an ethical mandate is neither compatible with the Christian world view, nor philosophically sound. ABOUT THE AUTHOR: James B. In describing his seven and a half years as a prisoner of war in North Vietnam, the late Vice Admiral James B. Stockdale has said: "In that atmosphere of death and hopelessness, stripped of the niceties, the amenities of civilization, my ideas on life and leadership crystallized." Despite torture, intimidation, and isolation, Stockdale fulfilled his duties as senior officer among the prisoners with intelligence and courage, defining rules of conduct and maintaining morale. He often described the intense pressures of (...) that situation as a "melting" experience, in which preconceived feelings, fears, and bias melt as one comes to realize that, under the gun, you must grow or fail—or, in some cases, grow or die. This collection of his essays and speeches from the 1980s and 1990s reinforces how that experience formed a lifelong basis for his philosophical thought on issues of character, leadership, integrity, personal and public virtue, and ethics. Zabarella and the Intentionality of Sensation - ABSTRACT: In this paper, I examine Zabarella’s account of the intentionality of sensation. By looking at both his account of the production of the sensible species as well as proper activity of the human soul in the process of sensation, I show that he has carefully reinterpreted standard medieval theories of sensation. Most notably, his account of intentionality as a kind of mental attention seems to point towards a type of Cartesian dualism, but (...) at the same time attempts to remain faithful to the basic insights of the Aristotelian tradition concerning sensation. Moreover, the collection allows us to analyze Wright’s relationship and contribution to the discipline of philosophy, both challenging and enriching its traditional ideas and concepts.

We critically examine Bermejo-Luque’s account of the logical dimension of argumentation and its logical or semantic evaluation. Our considerations concern her views on inference claims, validity, logical normativity, warrants, necessity, warrants and the justification of inferences, ontological versus epistemic modal qualifiers, ontological versus epistemic probability, and ontological versus conditional probability.

Unlike science fiction, which assumes a baseline of ordinary experience and sense of the nature of reality that are marked white, Black speculative literature's baseline is a parallel tradition responding to Black origins in slavery, racism, and colonialism; it imagines a future that critiques and is not bound up with science fiction's white origins in the onset of modernity. Its cosmologies and anthropologies are completely different. The Dark Delight of Being Strange is a work of but not about Black speculative (...) fiction. It explores the inherent meaning of speculative production for thinking, writing, living, and enacting concepts of Black freedom and why it is so critical for understanding Black sociality and politics. It combines memoir, storytelling, and philosophical prose with the Black imaginary to capture the idea that Black life is surreal, extraordinary--but not (or not only) in the sense of speculative fiction. It leaves us squarely in our world and time to reveal these aspects within the mundane or everyday. James Haile challenges us to rethink contemporary and historical Black life and approaches to freedom outside of Euromodernity in order to demonstrate the avant-garde aesthetic expressions critical to Black political thinking. It offers a rereading of enslavement through an innovative account of Henry Box Brown's famed escape, posits a parallel Black lifeworld as the destination of H. G. Wells' Journey to the Center of the Earth, thematizes time in Henry Dumas as an embodied phenomenological reality, imagines the survival skills of the octopus as an emblem for how to negotiate Black existence, theorizes memory as subject to metaphysical and ontological lack as a result of social alienation, questions whether there can be an outside--a place where Black people can be free--given the condition of death we call democracy as related in James Baldwin's letter to his nephew, and concludes by depicting Frederick Douglass as exemplar of the aesthetic, political, and philosophical Blackness that can be free. Each narrative is accompanied by a critical introduction and endnotes that provide philosophical context; together they argue that Blackness is a fundamental entanglement and not a limit--of the human or of freedom--rather somewhere beyond.
